VirtVPS Terms of Service

Last Updated: 6 October 2026

By purchasing, accessing, or using any service provided by VirtVPS (“VirtVPS”, “we”, “us”, or “our”), you (“Customer”, “Client”, or “you”) acknowledge that you have read, understood, and agreed to be bound by these Terms of Service (“TOS”), our Acceptable Use requirements, and any policies referenced herein.

Placing an order, making payment, renewing a service, or continuing to use a VirtVPS service constitutes acceptance of these Terms.

1. Services

VirtVPS provides Virtual Private Servers (VPS), dedicated servers, hosting services, IP addresses, network connectivity, and related infrastructure services.

Service specifications, availability, hardware, upstream providers, network routes, IP ranges, and underlying infrastructure may vary by location and may be changed where reasonably necessary for operational, security, network, abuse-prevention, maintenance, or infrastructure purposes.

Unless expressly stated otherwise in writing, no service is provided as a trial, evaluation, or “try before you buy” service.

2. No Trial and No Refund Policy

2.1 All Sales Are Final

All payments made to VirtVPS are final and non-refundable once an order has been accepted, provisioned, activated, or resources have been allocated to the Customer.

This applies regardless of whether the Customer subsequently decides that the service is no longer required, suitable, compatible with their software, accessible from their network, or appropriate for their intended use.

Customers are responsible for confirming that the selected service, location, operating system, resources, network characteristics, IP requirements, and other specifications are suitable for their intended purpose before ordering.

2.2 No Trial Period

VirtVPS does not provide a trial period unless expressly agreed in writing before an order is placed.

Purchasing a service for testing, benchmarking, VPN testing, IP testing, GeoIP testing, routing testing, software compatibility testing, latency testing, accessibility testing, or any other evaluation does not create a right to a refund.

2.3 Non-Refundable Circumstances

Without limitation, refunds will not be issued because of:

  • change of mind or accidental purchase;

  • failure to use the service;

  • Customer configuration errors;

  • operating system, software, application, VPN, proxy, tunnelling, or protocol compatibility issues;

  • ISP, carrier, national firewall, censorship, DPI, routing, peering, or connectivity restrictions outside the VirtVPS network;

  • IP reputation, third-party blacklist, blocklist, or reputation-database results;

  • IP geolocation discrepancies;

  • an IP address being identified differently by third-party GeoIP databases;

  • latency or routing differences caused by third-party networks;

  • inability to access a particular website, platform, application, game, streaming service, financial service, social network, or other third-party service;

  • third-party services blocking, restricting, rate-limiting, or rejecting an IP address;

  • Customer failure to read the product description or these Terms before purchase;

  • suspension or termination resulting from a violation of these Terms or our Acceptable Use requirements.

Cryptocurrency payments, dedicated servers, IP addresses, licences, add-ons, setup fees, custom orders, special orders, and third-party services are strictly non-refundable.

Nothing in this section excludes any refund or remedy that must be provided under applicable law and cannot lawfully be excluded by contract.

3. Exceptional Service Credit

At our sole discretion, VirtVPS may provide account credit where we determine that a material service failure was directly caused by VirtVPS and could not be reasonably resolved.

Any credit, refund, replacement, migration, IP change, extension, or other accommodation provided as a goodwill gesture does not create an entitlement, precedent, continuing obligation, or modification of these Terms.

Unless expressly agreed otherwise in writing, account credit has no cash value and cannot be withdrawn, transferred, or returned to the original payment method.

4. Cancellation

Customers may request cancellation of a service at any time through the authorised client area.

Cancellation stops future renewals but does not create a right to a refund for any unused portion of the current billing period.

Customers using recurring payment arrangements, including PayPal subscriptions or other external recurring payment mechanisms, remain responsible for cancelling those arrangements where they are controlled by the Customer.

For hourly, usage-based, or Pay-As-You-Go services, billing continues while the relevant resource remains active. The Customer is responsible for deleting or terminating the resource where required to stop further usage charges.

5. IP Addresses and GeoIP

IP addresses supplied with VirtVPS services remain under the control of VirtVPS and/or its upstream providers and are licensed for use only for the duration of the relevant service.

The physical location of a server and the location displayed by a third-party IP geolocation database are not necessarily the same.

GeoIP information is maintained independently by third parties, and databases may contain inaccurate, outdated, or inconsistent information. An IP address used on a server physically located in one country may temporarily or permanently be displayed as another country or city by certain GeoIP providers.

VirtVPS does not guarantee that any IP address will be identified as a particular country, city, region, ISP, organisation, ASN category, or usage type by every GeoIP database or third-party service.

Unless explicitly guaranteed in writing before purchase, GeoIP database classification is not a contractual characteristic of the service and is not grounds for a refund, cancellation refund, chargeback, or compensation.

Where possible, VirtVPS may submit or assist with GeoIP correction requests; however, acceptance and update times are controlled entirely by the relevant third-party databases.

6. IP Reputation and Third-Party Blocking

VirtVPS does not guarantee the reputation, history, classification, or acceptance of any IPv4 or IPv6 address by third-party services.

IP addresses may previously have been used by other customers or organisations. VirtVPS cannot guarantee that an IP address has never appeared on a blacklist, blocklist, reputation database, fraud-prevention system, VPN/proxy database, or similar third-party system.

VirtVPS is not responsible for restrictions imposed by external websites, payment providers, streaming platforms, email providers, search engines, social networks, gaming platforms, anti-fraud systems, ISPs, governments, or other third parties.

An IP address being blocked or rejected by a third party does not, by itself, establish a defect in the VPS or network service.

IP replacements are not guaranteed and may be refused or subject to an additional fee, particularly where repeated replacement requests result from Customer activity or circumstances outside our control.

7. Network Port Speeds

Network port speeds advertised by VirtVPS, including 1 Gbit/s, 10 Gbit/s, or other stated port speeds, refer to the maximum network interface or uplink capacity available to the relevant infrastructure unless expressly described as dedicated.

Where a service is advertised with a 10 Gbit/s shared port, the 10 Gbit/s capacity is shared amongst multiple virtual servers, customers, or workloads.

A 10 Gbit/s shared port does not guarantee that an individual VPS will continuously achieve 10 Gbit/s throughput.

Actual throughput may vary depending on network utilisation, server load, protocol overhead, routing, peering, destination capacity, congestion, single-stream performance, Customer configuration, virtualisation overhead, and other technical factors.

Bandwidth benchmark results, including results obtained through Speedtest, iperf, wget, or similar tools, do not alone establish a service fault.

Where technically and commercially reasonable, VirtVPS monitors shared network capacity and may increase or redistribute upstream capacity where sustained utilisation requires it.

8. Unmetered Bandwidth and Fair Usage

Where bandwidth is advertised as “unmetered” or “unlimited”, this means that no fixed monthly data-transfer quota applies under normal usage. It does not mean that the Customer is entitled to continuously saturate the physical network port or consume resources in a manner that materially degrades service for other customers.

Customers must use network resources reasonably and fairly.

VirtVPS may investigate, rate-limit, temporarily restrict, migrate, suspend, or contact Customers whose sustained bandwidth consumption adversely affects network stability, infrastructure, or other users.

Any specific committed bandwidth guarantee must be expressly stated in writing as part of the purchased service.

9. Routing, Latency and Internet Accessibility

VirtVPS does not guarantee any particular Internet route, upstream path, latency, packet-loss level, peering arrangement, or accessibility from every ISP, country, carrier, or network.

Internet routing is dynamic and may change without notice.

Connectivity problems caused by an external ISP, carrier, government restriction, national firewall, censorship system, DPI system, international routing issue, third-party network, or destination network are outside the control of VirtVPS.

In particular, the inability to establish a VPN, proxy, tunnel, SSH connection, or other protocol from a specific ISP or country does not establish that the VirtVPS server or network is defective where the service remains operational and reachable through other networks.

10. Email and SMTP

SMTP availability depends on the service type, location, IP reputation, and anti-abuse policies.

VirtVPS does not guarantee that outbound TCP port 25 or any other mail-related port will be available on every product.

Certain services, including some hourly or Pay-As-You-Go products, may have outbound SMTP ports restricted by default.

Customers must not use VirtVPS infrastructure for unsolicited bulk email, spam, phishing, email bombing, credential theft, or other abusive email activity.

We reserve the right to restrict SMTP access, impose rate limits, require verification, suspend mail functionality, or terminate services where necessary to protect our network and IP reputation.

11. Acceptable Use and Prohibited Activities

Customers must not use VirtVPS services for unlawful, abusive, fraudulent, or malicious activities.

Prohibited activities include, without limitation:

  • spam or unsolicited bulk messaging;

  • phishing or credential theft;

  • malware, ransomware, botnets, trojans, or malicious software;

  • DDoS attacks or participation in attacks against third parties;

  • unauthorised scanning, exploitation, intrusion, or access attempts;

  • fraud, impersonation, or deceptive activities;

  • distribution of illegal content;

  • copyright infringement where legally actionable;

  • hosting or distributing stolen data;

  • activities that threaten the security, reputation, stability, or availability of VirtVPS or its upstream providers;

  • deliberate abuse of network, CPU, storage, or other shared resources.

VirtVPS maintains a strict anti-spam policy. Serious or repeated abuse may result in immediate suspension or termination without refund.

12. Resource Usage

Unless explicitly described as dedicated, VPS resources may operate within shared virtualisation infrastructure.

Customers must not deliberately or persistently consume shared CPU, disk I/O, network, or other resources in a manner that materially affects other customers or infrastructure stability.

VirtVPS reserves the right to investigate abnormal resource consumption and, where reasonably necessary, apply limits, request corrective action, migrate the service, or suspend the affected workload.

13. Service Delivery

VirtVPS aims to provision services as quickly as reasonably possible, and many services may be activated automatically or shortly after payment.

However, any description such as “instant setup”, “instant deployment”, or similar wording represents the normal expected provisioning process and is not a guarantee of a specific delivery time.

Orders may be delayed for fraud screening, payment verification, stock availability, IP allocation, manual review, security checks, technical maintenance, or other operational reasons.

14. Customer Responsibility and Technical Compatibility

The Customer is responsible for determining whether a service meets their requirements before ordering.

VirtVPS does not guarantee compatibility with any particular software, VPN protocol, proxy software, operating system modification, control panel, application, website, third-party platform, or Customer-specific configuration unless expressly agreed in writing.

Root or Administrator access means the Customer is responsible for the administration, security, configuration, patching, and maintenance of the server unless a managed service has specifically been purchased.

15. Backups and Data

Customers are solely responsible for maintaining current, independent backups of their data.

Unless a separate backup service has been expressly purchased and confirmed, VirtVPS does not guarantee backups of Customer servers or data.

Customers must maintain backups outside the affected VPS or physical server.

VirtVPS shall not be responsible for data loss resulting from hardware failure, Customer error, operating system failure, malware, compromise, suspension, termination, cancellation, reinstallation, migration, storage failure, or other events, except to the extent liability cannot lawfully be excluded.

Before requesting an operating system reinstall, server deletion, migration, location change, or other destructive operation, the Customer is responsible for ensuring that all required data has been backed up.

16. Suspension and Termination

VirtVPS may suspend, restrict, or terminate a service where reasonably necessary due to:

  • non-payment or overdue invoices;

  • fraud or suspected fraudulent activity;

  • chargebacks or payment disputes;

  • abuse complaints;

  • violation of these Terms;

  • security threats;

  • malicious network activity;

  • spam;

  • legal or regulatory requirements;

  • requirements imposed by an upstream provider or data centre;

  • conduct that creates a material risk to VirtVPS infrastructure or other customers.

Where circumstances permit, we may provide the Customer with an opportunity to remedy the issue. Serious abuse, fraud, security threats, or urgent legal requirements may result in immediate action.

Termination for a Customer violation does not create a right to a refund.

17. Chargebacks and Payment Disputes

Customers should contact VirtVPS Support before initiating a chargeback, card dispute, PayPal dispute, or similar payment reversal so that we have an opportunity to investigate and resolve the matter.

Where a payment is disputed or reversed, VirtVPS may suspend the associated services while the dispute is investigated, particularly where continued provision would expose VirtVPS to further financial loss.

VirtVPS may provide payment records, order information, service provisioning records, login and usage records, support correspondence, IP allocation records, acceptance of these Terms, and other relevant evidence to the payment processor or financial institution handling the dispute.

Fraudulent or abusive chargebacks may result in account termination and refusal of future service.

18. Dedicated Servers

Dedicated server orders involve the reservation and allocation of physical infrastructure and are non-refundable once accepted or provisioned.

Hardware replacements, network maintenance, or other technical interventions do not create a refund entitlement unless expressly agreed otherwise in writing or required by applicable law.

19. Maintenance and Service Interruptions

VirtVPS may perform scheduled or emergency maintenance when reasonably necessary.

Temporary interruptions may occur as a result of maintenance, hardware replacement, network changes, upstream-provider issues, security incidents, DDoS attacks, software failures, or circumstances beyond our reasonable control.

VirtVPS does not guarantee uninterrupted or error-free operation unless a separate written Service Level Agreement expressly provides otherwise.

20. Limitation of Liability

To the fullest extent permitted by applicable law, VirtVPS shall not be liable for indirect, incidental, special, consequential, or economic losses arising from the use or inability to use the service, including loss of profit, revenue, business, opportunity, goodwill, or data.

Where liability cannot legally be excluded, VirtVPS’s aggregate contractual liability relating to a particular service shall, to the extent permitted by applicable law, be limited to the amount paid by the Customer to VirtVPS for that affected service during the billing period giving rise to the claim.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

21. Changes to Infrastructure

VirtVPS may change hardware, IP allocations, upstream providers, network architecture, routing, data-centre infrastructure, virtualisation technology, or other technical components where reasonably required to maintain, secure, improve, or continue providing the service.

Where a material change would substantially alter the core service purchased by the Customer, VirtVPS will take reasonable steps to minimise disruption.

22. Support

Technical support covers matters relating to VirtVPS infrastructure and the operation of services supplied by VirtVPS.

Unless a managed service has been purchased, VirtVPS is not responsible for configuring, debugging, securing, administering, or repairing Customer-installed applications, websites, VPN configurations, scripts, control panels, databases, or other third-party software.

Assistance provided outside the normal scope of support is provided as a goodwill effort and does not create an ongoing obligation.

23. Account Security

Customers are responsible for maintaining the confidentiality and security of their account credentials, server passwords, SSH keys, API credentials, and other authentication information.

Activity performed through a Customer account or service may be treated as authorised activity unless VirtVPS has been notified of a suspected compromise.

Customers must immediately notify VirtVPS if they reasonably believe their account or server has been compromised.

24. Amendments

VirtVPS may update these Terms from time to time to reflect changes in services, infrastructure, security requirements, legal requirements, or business operations.

The current version published on the VirtVPS website will apply from its stated effective date, subject to any notice requirements imposed by applicable law.

25. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be interpreted or limited to the minimum extent necessary, and the remaining provisions shall continue in effect.

26. Entire Agreement

These Terms, together with any applicable product-specific terms, Acceptable Use Policy, Privacy Policy, and expressly agreed written service conditions, constitute the agreement governing the Customer’s use of VirtVPS services.

Product-specific written terms expressly stated at the time of purchase may supplement these Terms. In the event of a direct conflict, any mandatory legal rights that cannot be excluded will continue to apply.

By placing an order, making payment, renewing a service, or continuing to use a VirtVPS service, the Customer confirms that they have read, understood, and accepted these Terms of Service.
